Terms of Service (ToS)
1. Parties and Subject of the Subscription Agreement
1.1 These Terms of Service ("ToS") govern the relationship between the WebTV platform swissskate.tv, operated by Swiss Sport TV, and the paying viewers (customers) for the service offered.
1.2 Access to the paid content may only occur through the personal login provided by swissskate.tv. A single purchase or subscription entitles only the recipient to access the paid swissskate.tv content for private use. Users must prevent any redistribution of login information or paid content.
2. Changes to the Program Offer
2.1 The scope of the swissskate.tv program offer is described on the swissskate.tv website. Swiss Sport TV may engage third parties for service delivery.
2.2 Swiss Sport TV reserves the right to modify the swissskate.tv program offer at any time, including adding, expanding, reducing, or otherwise altering the content.
2.3 As long as the overall nature of the individually purchased or subscribed swissskate.tv program remains the same, this does not constitute an extraordinary termination right for the subscriber. Otherwise, the subscriber may terminate the subscription agreement prematurely, without financial consequences, up to the time the change becomes effective (see clauses 12.3, 12.4, and 12.5). Failure to do so constitutes acceptance of the change.
3. Subscription Fees
3.1 Fees for the swissskate.tv program are based on the current prices published with the paid content on swissskate.tv. The customer accepts the applicable fees with their purchase.
3.2 The customer is required to pay the fees for the entire contract duration in advance according to the agreed payment period. Accepted payment methods include common credit cards and Twint.
3.3 In case of payment default, Swiss Sport TV may, to the extent legally permissible, revoke viewing rights without prior notice and/or take further measures to prevent additional damages until full payment is made. Swiss Sport TV may also terminate the subscription agreement immediately and without compensation. A justified revocation of viewing rights does not create any compensation or replacement claims for the customer, and their payment obligation remains. If Swiss Sport TV terminates the agreement, the customer owes the fees for the remaining contract term (see clauses 12.3, 12.4, and 12.5).
3.4 Swiss Sport TV may adjust fees at any time. Subscription fee increases will be communicated to subscribers in advance in an appropriate manner. If the fee increase results in higher overall costs for the subscriber, they may terminate the subscription agreement prematurely, without financial consequences, by the effective date of the change. Failure to do so constitutes acceptance of the change. Adjustments to fees due to changes in taxes or charges (e.g., VAT) do not count as fee increases and do not justify premature termination.
4. Registration Fee
Swiss Sport TV does not charge a registration fee.
5. Program Guide
Customers can view the start times of content on the website in the respective video player. This information is accessible on swissskate.tv.
6. Transmission Interruptions
6.1 Technical issues such as livestream interruptions, visual disturbances, bandwidth problems, or unavailability of recordings do not justify a refund, even partial, of the purchase price. The purchase price entitles access to the paid content and is independent of the functionality of individual videos or livestream content. While Swiss Sport TV strives to ensure functional content, it depends on technical factors like internet availability and the reliability of the producing clubs.
7. Customer Responsibilities
7.1 The customer is responsible for providing, installing, and operating all devices (PC, notebook, tablet, smartphone, smart TV) and connections (fixed-line internet, mobile) necessary to access the purchased swissskate.tv programs and subscriptions. Swiss Sport TV strives to make swissskate.tv content accessible on all devices, platforms, and browsers but does not guarantee functionality.
7.2 Changes to the customer's data (e.g., email address) after contract conclusion must be promptly reported to Swiss Sport TV. If the customer wishes to change the payment method chosen at contract conclusion, they must inform Swiss Sport TV in advance.
8. Swiss Sport TV Liability
8.1 Swiss Sport TV is not liable for any damages to customer-owned devices or other items arising from using swissskate.tv. Swiss Sport TV is also not liable for incompatibility between devices. Liability for data loss or deletion, including during software updates provided free of charge by Swiss Sport TV, is excluded.
8.2 Swiss Sport TV is not responsible for interruptions to the swissskate.tv platform due to force majeure or other circumstances beyond its control, such as actions or omissions by telecommunication providers, power suppliers, data centers, or other third-party service providers. Swiss Sport TV is also not liable for interruptions, misuse, or damages caused by third parties.
9. Copyright
Recording broadcasts onto storage media for use outside the subscriber's private circle (family, friends) is prohibited and violates copyright laws. Customers may not publicly display or make swissskate.tv content available, e.g., by uploading to peer-to-peer networks, nor use it commercially. Redistribution or reception of paid swissskate.tv content in public spaces (e.g., restaurants, bars, hotels, cinemas) is not permitted without Swiss Sport TV's explicit consent and violates copyright laws. Unauthorized use of swissskate.tv content breaches both contractual obligations to Swiss Sport TV and potentially third-party rights, exposing the customer to claims by Swiss Sport TV or third parties.
10. Misuse
10.1 Customers must comply with these ToS and legal provisions when using Swiss Sport TV services. Unauthorized use of swissskate.tv content and the platform, including software interference by the customer or third parties, is expressly prohibited.
10.2 Swiss Sport TV may, to the extent legally permissible, revoke viewing rights without prior notice and/or terminate the subscription agreement without compensation in case of illegal or contractual violations by the customer. A justified revocation does not entitle the subscriber to compensation, and payment obligations remain. Termination of the subscription agreement obligates the customer to pay the fees for the remaining contract term (see clauses 12.3, 12.4, and 12.5).
11. Data Protection
Swiss Sport TV is committed to handling customer data carefully and using it only within the framework of Swiss data protection laws. By accepting these ToS, the customer consents to Swiss Sport TV collecting and processing personal data provided during ordering, customer service interactions, and service usage. Swiss Sport TV may use customer data for technical and organizational purposes, including service design and development. It may also share customer data with third parties for purposes such as customer relationship management, technical solutions, or debt collection. 12. Subscription Duration and Termination
12.1 The contract begins with the online purchase by the customer. Swiss Sport TV provides the service immediately.
12.2 Single purchases are valid until June 31 of the purchase year. Access may remain available beyond this date but is not guaranteed. Single purchases do not auto-renew and grant access to purchased content during the contract period and beyond, as long as available.
12.3 Monthly subscriptions have a minimum term of one month and automatically renew unless canceled. They provide access to all paid content during the subscription period.
12.4 Subscriptions can be canceled without cost and without notice at the end of each period through the user account on the website.
12.5 Early cancellations, outside explicitly allowed cases, do not exempt the customer from paying fees for the remaining contract period or the minimum term ("remaining fees").
12.6 Upon termination, all outstanding amounts, including remaining fees, become due.
13. Final Provisions
13.1 Swiss Sport TV reserves the right to amend the ToS at any time. Changes will be communicated to subscribers. Subscribers may terminate their subscription early if changes are disadvantageous. Failure to do so constitutes acceptance of the changes.
13.2 Transfer of the agreement or rights and obligations under it requires mutual written consent. However, Swiss Sport TV may transfer the agreement or claims to third parties for collection purposes without customer consent.
13.3 This agreement is governed exclusively by Swiss law. The place of jurisdiction is Hochdorf. Mandatory statutory jurisdictions remain reserved.
